Motorcycle Accident

Motorcyclists are a breed of their own. I can relate and appreciate the joys of riding, but as a lawyer with experience representing injured victims, I also know the associated risks of riding a motorcycle. I know that far too often other drivers are distracted, fail to keep a close look-out, and/or disregard motocyclists. This results in too many motorcyclists being injured and killed each year.

I have had the unfortunate and tragic experience of witnessing the trauma, injuries, and damage caused by negligent drivers. The human body is simply not constructed to tolerate and stand up against the impact of a car or truck which outweighs the motorcyclist by several thousand pounds and has a strength that far exceeds any human body.

With sincere compassion and a proven successful track record, I have represented the victims who have survived these tragic crashes only to go on to suffer broken limbs, amputations, and traumatic brain injuries. I have battled the insurance companies and have successfully been able to secure compensation and justice for my clients and for the family members left behind after their loved one tragically lost a life due to the carelessness and negligence of another driver.

Whether you are dealing with the claim adjuster with the insurance company or a jury, as a motorcyclist unfortunately, you begin your case at a disadvantage. Insurance claim adjusters and juries tend to initially view motorcyclists in a biased way, remembering a past visual of a speeding racing-style reckless motorcyclist (referred to as a “crotch rocket”) blasting past them on the interstate at over 90 mph. The insurance companies assume that all motorcyclists fit this stereotype and apply it to your case. To overcome this prejudice, you need an experienced trial lawyer who has the reputation of being successful and who will tailor and develop your case to assist you or your family in receiving the compensation you deserve for medical bills, lost wages, and, most importantly, pain and suffering.

I handle motorcycle accident cases on a contingency fee basis. This means that there is never an attorney fee charged unless I successfully negotiate a settlement or receive a judgment in court on your behalf.

If you or a loved one suffered a serious injury or even death because of a motorcycle accident, contact Thurman Law Office for help. We have the experienced team necessary to gather all of the evidence, including any documentation, photographs, witness statements, medical records, and more that may help strengthen your case. ATV/UTV accident

All-Terrain Vehicles, also known as ATVs, and Utility Task Vehicles, also known as UTVs, are motorized off-road vehicles that have four wheels. They are very popular in Kentucky and Indiana, and are often used on camping trips and vacations, as well as for other outdoor excursions. While they can be a safe and fun way to experience an exhilarating outdoors adventure, they are inherently dangerous and can be extremely dangerous and even fatal. An ATV can travel at 60 miles an hour and weighs up to 800 pounds. They are known for catastrophic accidents that can swiftly take the lives of the drivers and/or passengers. These vehicles carry risks of serious injury and death. According to the latest data from the Consumer Product Safety Commission (“CPSC”), there were 15,744 ATV-related fatalities between 1982 and 2018, with 21 percent of those occurring in children younger than 16 years of age. In 2016, there were also an estimated 101,200 ATV-related emergency department-treated injuries in the U.S. An estimated 26 percent of those involved children younger than 16 years of age. There are an estimated annual average of 105,400 emergency department treated injuries associated with these vehicles. The CPSC has also analyzed the data to find the states with the highest number of reported deaths during 2017 – 2019 were The states with the highest number of reported deaths during the 3-year period were Texas (113), California (107), West Virginia (106), Pennsylvania (98), and Kentucky (95). They found that Texas ranked first, followed by California, West Virginia, Pennsylvania, and Kentucky, with Indiana coming in twentieth. Some of the dangers of all-terrain vehicles (ATVs) include:

  1. Accidents and Injuries: ATVs can be unstable and prone to rollovers, especially when driven at high speeds or on uneven terrain. This can result in serious injuries or even fatalities, including head and spinal injuries, fractures, and internal injuries.

  1. Lack of Safety Features: ATVs are not equipped with safety features like seat belts, airbags, or roll cages, making riders more vulnerable to injuries in case of accidents.

  1. Inexperienced Riders: Many ATV accidents occur due to inexperienced or underage riders who may not have the necessary skills or knowledge to operate these vehicles safely.

  1. Speeding and Reckless Driving: Not realizing that ATVs can be just as dangerous as passenger vehicles, if not more dangerous even a caution must be Some ATV riders may engage in reckless behavior, such as speeding, performing stunts, or riding under thes influence of alcohol or drugs, increasing the risk of accidents.

  1. Terrain Hazards: Riding ATVs on rough or unfamiliar terrain can expose riders to various hazards, including rocks, tree stumps, ditches, or other obstacles that can cause accidents or injuries.

  1. Lack of Protective Gear: Failure to wear appropriate safety gear, such as helmets, goggles, gloves, and sturdy footwear, can increase the risk of severe injuries in case of accidents.

  1. Passenger Risks: Carrying passengers on ATVs designed for a single rider can affect the vehicle’s stability and increase the chances of accidents.

  1. Legal Restrictions: Violating ATV laws and regulations, such as riding on public roads or operating without proper permits or licenses, can result in fines or legal consequences.

  1. Driving an ATV on Pavement; ATVs are not intended to be driven on paved roads – that’s why they are called off-road vehicles. They do not perform well on pavement which can quickly lead to rollovers, losing control of the ATV, and other issues.

These dangerous vehicles could and should be made safer with common sense design changes.

If you or a loved one suffered a serious injury or even death because of an ATV or UTV incident, contact Thurman Law Office for help. Our attorneys are committed to using our experience and resources to provide providing aggressive representation to victims to maximize the settlement and trial value of nursing home cases.

Premises Liability / Slip and Fall Accidents

Injured From A Premises Liability Accident?

Premises liability law concerns the legal responsibility of a property owner or tenant for accidents or injuries incurred by others on their property. If you or a loved one suffered an injury on another person’s or company’s property, you should speak to a premises liability lawyer.

Thurman Law is experienced in premises liability claims in Kentucky and Indiana. To schedule a free consultation to discuss your potential case, contact our law office today.

Types of Accidents

Premises liability law may pertain to many types of accidents that can occur in many different circumstances. Some examples include:

  • Slip and Fall: Examples include a shopper slipping and falling on a wet store floor, an uneven sidewalk that trips the unsuspecting walker, a gardener falling out of a tree he was trimming, someone slipping and falling on another person’s boat and hitting his or her head, slippery porch steps after a snowstorm, or an icy sidewalk where someone slips and falls.
  • Being hit by a falling object: An example of this might be some heavy item falling from a store shelf and hitting the shopper on the head.
  • Being bitten by a dog or other pet in someone’s home: The homeowner could be liable for the injuries incurred when a visitor to their home is bitten by the animal. This would be particularly true if the owner knew about the pet’s unpredictable nature.
  • Building or balcony collapses due to poor construction or age of the building.
  • Elevator or escalator accidents.
  • Drowning in a neighbor’s swimming pool might make the homeowner liable.

Some examples of negligence include:

  • Not repairing a weakened porch step that causes a visitor to fall
  • Failing to clean up a spill that caused a person to fall
  • Failing to provide adequate warning signs after mopping a floor
  • Failing to repair an exposed wire that causes someone to trip
  • Failing to provide good lighting in a parking lot or garage where someone slips and falls on a grease spot
  • A boat lacking hand holds to prevent someone from falling overboard
  • A faulty heater in a house that burns a guest
